Terms & Conditions
The terms and conditions specified are specific to orders on our website and for delivery to the UK. Placing an order constitutes your acceptance thereof.
Payment:
We accept the following credit & debit cards on The Vegetable Bed web site, through our secure payment server WorldPay. Visa, Mastercard, Visa Delta, Visa Electron, Solo, Maestro UK.
Payment can only be accepted in pound sterling.
All credit & debit cards are subject to validation checks and authorisation by the card issuer when you place an order. If the issuer of your payment card refuses or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
The Vegetable Bed accepts UK cheques crossed and made payable to: The Kitchen Gardener Ltd. All cheques must be cleared before products are dispatched.
All goods remain the property of The Vegetable Bed until full payment has been received.
Privacy:
The Vegetable Bed is committed to protecting your privacy. We will only hold your information for the purpose of administering your account and marketing. If you do not wish to receive marketing information from us, please let us know.
We never sell personal information to other companies.
Delivery: The Isles of Wight, Man, and Scilly, Northern Ireland, plus the Scottish Highlands and Islands: for orders weighing less than 2kg the normal UK mainland carriage charge applies. Where the combined weight of the order is 2kg and above, the carriage contribution is £12. The Channel Islands and Southern Ireland: for orders weighing less than 2kg the normal UK mainland carriage charge applies. Where the combined weight of the order is 2kg and above, the carriage contribution is £15. We reserve the right to contact you and advise an additional charge where necessary, and are happy to quote for carriage of specific products to outlying areas. Some very large items may not be available to all areas Formation of Contract:
Orders of packet seeds, garlic and onion and shallot sets only incur a charge of £1.50 and orders for herb plants is £4.50. Orders for all other products incur a carriage charge of £7.95. Where an order includes both packet seed and other items, only one charge will apply.
Requests to purchase products on this site amount in law to an offer only to purchase at the stated amount. No binding contract in law is formed until such time as e-mail is sent by the Company to the e-mail address of the customer in which it is stated that such offer is accepted.
Liability:
The Vegetable Bed's total liability for any claim howsoever arising shall not exceed the price of the goods supplied. The Vegetable Bed shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way.
The Vegetable Bed cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including account details or details you provide us when accessing or ordering from The Vegetable Bed web site, unless this can be proven in law to be due to our negligence.
The Vegetable Bed will not be liable for any damage or injury arising out of any of products purchased from The Vegetable Bed web site. Operating & safety instructions are supplied where necessary by our suppliers. The Vegetable Bed cannot be held liable for the misuse of any of the product we sell.
Returned or Exchanged Items:
You can return or exchange your order within 14 days from receipt of order. The item must be returned unused and in its original packaging. Return delivery costs are non-refundable. Please notify us via email info@thevegetablebed.com or telephone 01732 700334 to obtain a return or exchange number before returning any goods. A returned or exchanged item is the customer's responsibility until received by The Vegetable Bed.
Damaged Goods:
In the unlikely event you receive a damaged item, please contact us within 5 days of receipt. We can then arrange for a refund or replacement once the damaged item has been returned to us. In these circumstances The Vegetable Bed will reimburse you for the reasonable delivery cost of the returned damaged item.
Shortage in Order:
In the unlikely event you do not receive your full order, please contact us within 5 days of receipt of order.
Produce Images and Descriptions:
Every care is taken to ensure descriptions and specifications of the products shown on our web site are correct. All dimensions are approximate and slight colour variations may occur due to the nature of photo reproduction onto the web site or a product being handmade.
The Vegetable Bed assumes no responsibility for the content of any web sites which The Vegetable Bed web site has links to.
Jurisdiction:
Every purchase made on The Vegetable Bed web site shall be deemed performed in England. The use of the website and the Terms & Conditions shall be governed, construed and interpreted in accordance with English law and you agree to submit to non-exclusive jurisdiction of the English court.
Statutory Rights:
These Terms & Conditions do not affect your statutory rights.
